Terms and Conditions

These Terms and Conditions (“Terms”) govern the sale of products and services by Flor’all Eternity (“we”, “us”, “our”). By placing an order with us, whether in person, by email, or by telephone, you (“you”, “the Customer”) agree to these Terms in full.

If you do not agree with these Terms, you should not proceed with an order.

 

  1. Definitions

Products – items created and supplied by us, including but not limited to jewellery, resin art, and keepsakes.

Personalised Products – Products made to order, often incorporating materials supplied by the Customer (e.g. ashes, breast milk, flowers, hair, fur, fabric).

Order – a confirmed request made by the Customer for Products following consultation with us.

Customer Materials – any personal or sensitive materials provided by the Customer for use in the creation of Personalised Products.

 

  1. Orders and Acceptance

2.1. Orders are arranged directly with customers, usually face-to-face, during a personal consultation where we visit you to discuss your requirements. Orders may also be agreed by telephone, email, or written correspondence.
2.2. Once details have been agreed, we will provide confirmation of your Order in writing (either on paper or electronically). The Order will only be deemed accepted once we have issued this written confirmation.
2.3. We reserve the right to decline or cancel an Order if the materials provided are unsuitable, unsafe, or if we are otherwise unable to fulfil the request.

 

  1. Personalised and Sensitive Materials

3.1. If your Order involves the use of Customer Materials, you are responsible for ensuring these are safely handed to us at the time of consultation or securely delivered by an agreed method.
3.2. We cannot be held liable for loss or damage to Customer Materials prior to their receipt by us.
3.3. We handle all Customer Materials with the utmost care and respect. However, as each Personalised Product is handmade and unique, results may vary slightly from descriptions or sample images.
3.4. Any unused Customer Materials may be returned upon request, although this cannot be guaranteed in all cases.

 

  1. Pricing and Payment

4.1. Prices will be confirmed with you during consultation and documented in your Order confirmation.
4.2. All prices are in pounds sterling (GBP) and include applicable UK taxes.
4.3. A deposit may be required at the time of Order, with the balance payable upon completion, unless otherwise agreed in writing.
4.4. We accept payment by cash, bank transfer, or other methods agreed during consultation.

 

  1. Production and Delivery

5.1. Production of Personalised Products begins only once your Order has been confirmed and, where applicable, your Customer Materials have been received.
5.2. Estimated production times will be provided at consultation. These may vary depending on the complexity of the piece and the materials involved.
5.3. Products are normally hand-delivered at a follow-up appointment. Alternative arrangements, including courier delivery, may be made if agreed in advance.
5.4. Ownership of Products passes to you once full payment has been received and the Product has been delivered.

 

  1. Returns, Refunds and Cancellations

6.1. Due to the bespoke nature of Personalised Products, cancellations, returns, or refunds are not possible once production has begun, except where the Product is faulty, damaged, or incorrect.
6.2. If you believe a Product is defective, you must notify us within 14 days of receipt, providing clear evidence of the issue. We will assess the claim in good faith.
6.3. Where a refund or replacement is agreed, Customer Materials cannot be guaranteed to be retrievable or reused.
6.4. Non-personalised Products, if offered, may be returned within 14 days of receipt provided they are unused and in their original condition. Return arrangements will be discussed on a case-by-case basis.

 

  1. Intellectual Property

7.1. All designs, images, text, and content created by or on behalf of Flor’all Eternity remain our intellectual property.
7.2. Customers must not reproduce, copy, or otherwise use our designs, photographs, or branding without our prior written consent.

 

  1. Limitation of Liability

8.1. While every effort is made to ensure Products are of the highest quality, our liability for any claim shall not exceed the value of the Order.
8.2. We are not responsible for indirect, incidental, or consequential losses, including emotional distress, arising from the use of our Products or services.

 

  1. Privacy

9.1. We respect your privacy and only collect and process personal information necessary to fulfil your Order.
9.2. Any personal data shared with us is handled in line with the UK General Data Protection Regulation (UK GDPR).
9.3. By placing an Order, you consent to our use of your information for communication, fulfilment, and record-keeping purposes.

 

  1. Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.

 

  1. Changes to Terms

We may update these Terms from time to time. The latest version will always be made available to you and will apply to any Orders placed thereafter.
